Entire Agreement:

This agreement contains the entire understanding between the Clients and the Photographer in regard to any Hiring,  Weddings and Commercial Work

Confirmation:

A signed “Contract for Wedding Photography Services” and payment of the booking fee are necessary to confirm the stated wedding services from the Photographer.

Pre-Wedding Consultation: This normally happens at the time of booking. The Clients will outline broadly what is required and the Photographer will advise on planning, logistics and timings where needed. If required the Clients are welcome to pop in for an additional chat closer to the time of the wedding (about 2 weeks) to iron out the remaining details. In any case we will contact you by phone a few days before the wedding to ensure that there have been no last-minute changes.

Cooperation:

The Clients and the Photographer consent to professionally cooperating and communicating with each other to achieve the best possible result within the understanding of this contract. We recommend that the Photographer be provided with a helper (usually the best man for weddings or a company representative / set list for commercial shoots) if possible who will point out key individuals to be photographed. The Photographer may also require the assistance of the best man in organising family groups. The Clients also agree to give the Photographer sufficient warning of key events at the wedding to give the Photographer time to prepare e.g. Bouquet throwing, cutting the cake, speeches etc. Please note that not all guests at weddings like having their photo taken. In such cases the Photographer will use his discretion but cannot be held responsible for a lack of photos of these people

The Schedule:

Our shooting schedule, style of working and experience are designed to achieve a great set of photos. Both the Clients and the Photographers therefore agree that punctuality and cooperation are essential to producing the desired photographic results. In cases where things do not run on time we cannot guarantee to take our normal set of photos although in such circumstances we will do our absolute best.

Paparazzi Wedding Guests:

All your guests will have digital cameras and all your guests will want to photograph the Clients. The Clients agrees to give the Photographer(s) precedence over the guests in order to take the photographs required for the wedding services described above. We cannot be held liable for a lack of wedding photos if guests taking their own photos of the Clients continually interrupt the Photographer's work.

Wedding House Rules:

The Photographer(s) are sometimes limited by rules imposed by registrars, ministers and venue management as to what can and cannot be done. For example some ministers insist that no flash photography is allowed, and others will insist that the Photographers shoot from a specific location. In such circumstances the Clients agree to accept the technical limitations that may be imposed on the photographer and equipment used. We advise Clients to make themselves aware of the rules of the venue concerned and if necessary negotiate with the personnel concerned.

Copyright:

The copyright of photographs remains with the Photographer. The Photographer grants the Clients permission to make copies of the images under the following conditions. The images taken by the Photographer are for personal use by the Clients and their friends and relatives, commercial use is restricted to use of the agreed shoot remit. Sale, Publication or any Commercial use of the photographs outside of the agreement is not allowed without prior written permission from the Photographer. Copying of images from this website is also strictly forbidden.

Model Release:

The Clients grant the Photographer and its legal representatives, heirs and assigns, the irrevocable and unlimited consent to use the photographs of the Clients for editorial, competition, advertising and any other purpose and in any manner, to alter the photographs without restriction; and to copyright the images. The Clients hereby release the Photographer and its legal representatives, heirs and assigns from all liability and claims in connection with the images. Copyright may be transferred but only with the photographers written permission.

Limit of Liability:

If a photographer is too ill or becomes injured and cannot supply the services specified above the Photographer will try to book a replacement photographer. If both photographers are unavailable and another replacement photographer cannot be found, then liability is limited to a refund of any payments received. The Photographer(s) have working methods in place to prevent loss or damage to your images. However, there is the unlikely possibility that images may be lost, stolen or destroyed for reasons in or beyond our control. In these circumstances liability is limited to the return of fees paid for the service or part thereof according to the percentage of images supplied. The Photographer(s) is not liable for any loss or damage to Clients equipment or belongings under this contract.

Booking Fee/Deposit:

In the event of the Clients cancelling the wedding for whatever reason the booking fee is non-refundable.

Events & Hire a Photographer

Entire Agreement: This agreement contains the entire understanding between Client and the Photographer.

Photographer agrees to work for the Client as an independent contractor, providing photography-related services.

Independent Contractor:

The Client and Photographer specifically agree that the Photographer is performing the services as an independent contractor and is not an employee of the Client.

Cooperation:

The Client and the Photographer consent to professionally cooperating and communicating with each other to achieve the best possible result within the understanding of this contract. The Client also agrees to give the Photographer sufficient warning of key events to give the Photographer time to prepare. Please also note that not all people like having their photo taken. In such cases, the Photographer will use his discretion but cannot be held responsible for a lack of photos of these people.

Copyright & Reproduction Rights:

The copyrights of the photographs remain with the Photographer. Client agrees not to sell any image taken during the contracted event to any person, company, group, advertising agency, or otherwise, without the Photographer's express written permission except in terms of a commercial contract where images must only be used in that agreed contract. The photographs submitted by the Photographer will only include the Client's and the Photographer's watermarks. The Photographer grants Client permission to use the images taken during the contracted event for Client's professional use in the following manner: Print portfolio and website (including but not limited to blog, Facebook, Twitter, Instagram, etc.) immediately after date of event. Web use shall include an accompanying "G17 Photography Services" credit line. Any use that exceeds this limited scope is strictly prohibited unless otherwise agreed.

Model Release:

The Client grants the Photographer and its legal representatives, heirs, and assigns, the irrevocable and unlimited consent to use the photographs of the Client for editorial, competition, advertising, and any other purpose and in any manner, to alter the photographs without restriction; and to copyright the images. The Client hereby release the Photographer and its legal representatives, heirs, and assigns from all liability and claims in connection with the images.

Confidentiality:

Client understands that all materials, price lists, contracts, financial documents, agreements, and other information or documents that are given to him/her, are the exclusive property of the Photographer, and are privileged, confidential information. Client agrees not to reveal this information to anyone, nor to use this information to the detriment of the Photographer in any way.

Limit of Liability:

The Photographer is not liable for any loss or damage to Clients equipment or belongings under this contract. In the unlikely possibility that images may be lost, stolen, or destroyed for reasons in or beyond our control, liability is limited to the return of fees paid for the service or part thereof according to the percentage of images supplied.

Booking Fee/Deposit:

In the event of the Client cancelling the Event for whatever reason the booking fee deposit is non-refundable.

The Photographer

Creative License: Images are recorded and edited at the Photographers discretion, delivered images may not include all images shot. The Photographer reserves the creative rights to edit and release only those images deemed creditable as professional in quality and within the photographers artistic standards.

Force Majeure:

If the Photographer or its assigns cannot perform any of the above Agreements due to a fire, casualty, strike or other civil disturbances, Acts of God, including but not limited to, road closures, severe traffic, fire, terrorism or other causes including illness, beyond the control of the parties, then the Photographer shall return any moneys paid by the Client, less booking fee and expenses, but shall have no further liability with respect to the Agreement. This limitation of liability shall also apply in the event that photographic materials are damaged, lost through camera malfunction, compact flash card malfunction, or otherwise lost or damaged without the fault on the part of the Photographer.
